Minutes

President Kathy Kolody called the Oceanside Neighborhood Association special meeting to order at 10:22 a.m. Saturday, August 28, 2004, in the Oceanside chapel. There were 89 persons listed on the attendance sheet. The special meeting was to consider the Anchor Tavern's application for conditional use permits to expand the tavern by building 10 guest rooms on two upper stories and by using a 7,000-square-foot lot on Hillcrest Avenue for off-site parking.

Kathy described the purpose of the association and set out ground rules for the meeting. She then introduced Lynn Krueger of the Tillamook County Community Development Department, who said the planning commission would decide two issues: the accessory use for a parking lot in a residential zone, and the expansion of the tavern with 10 guest rooms. She reviewed the conditional use criteria and other aspects of the county zoning ordinance. She said the planning commission would hold its hearing at 7 p.m. Thursday, Sept. 9, 2004, and if anyone wished to write comments on the application, the letters must reach her by 5 p.m. Sept. 1. She said comments could be sent by mail or by e-mail, and gave her e-mail address: lkrueger@co.tillamook.or.us.

Kathy introduced Steve Camden, the owner of the Anchor Tavern, through Camden Inns LLC, who responded to questions about his application. He reviewed his plans for the tavern, starting with an arrangement with a real estate office that would lease the second story. The real estate agency decided against renting the space, so Steve said he began planning for five guest rooms above the tavern and parking spaces leased from the fire district. However, he said county said he needed a permanent parking solution, so he decided to create 10 guest rooms and buy a lot for parking on Hillcrest Avenue.

On a series of questions, he said the deed restrictions on the parking area prohibited pole lighting, so his intent is to install nothing above landscape lighting; he added that he would keep as much natural area look as possible, using shrubbery, rocks and whatever the building department requires; he said he would put in a mechanism to limit access to the parking area and do whatever the planning commission requires. "I will secure access in accord with what the code requires and what the planning commission requires."

Asked whether the tavern is back on the market, and if a new owner would live up to Steve's verbal commitments, he said it was being offered for sale. He said it was his usual practice when he buys a property to put it back on the market "to establish our own value for the asset." He added, however, that "We'll ask Pam [Zielinski] to remove the listing."
After discussion, the association voted on two motions. They are:

Motion number one adopted by the Oceanside Neighborhood Association

Dick Butler moved that the Oceanside Neighborhood Association opposes the portion of the Anchor Tavern's conditional use application that applies to adding 10 guest rooms in the two upper stories. Liz Wilkerson seconded the motion. The reasons are:
1. Conditional Use Review Criteria Section 6.040 - Criteria #4:
a. It would change the flavor of the neighborhood and would have an adverse impact on the Tillamook Avenue residents in that it would increase traffic flow and jeopardize the safety of the residents.
b. It would impair access to driveways for Tillamook Avenue residents because of the increased traffic, further jeopardizing safety.
2. Conditional Use Review Criteria Section 6.040 - Criteria #6:
a. There is no acceptable commercial parking in the area.
b. There is no parking enforcement in the commercial area.

The vote was 40 in favor of the motion, 19 opposed to the motion and 2 abstaining.

Motion number two adopted by the Oceanside Neighborhood Association

Kathy Norris moved that the Oceanside Neighborhood Association opposes the portion of the Anchor Tavern conditional use application that applies to establishing an off-site parking lot on Hillcrest Avenue near Chinook Avenue. It was seconded by David Van Speybroeck. The reasons are:

1. Conditional Use Review Criteria Section 6.040 - Criteria 3 & 4
a. The parcel is not suitable for the proposed use in that the property lines of seven private residences touch this parcel. This will alter the character of this residential neighborhood and impair existing property owners.
b. The parking lot would alter the character of the surrounding area, putting a motel parking lot in a residential area. The parking lot would create an attractive nuisance with cars, alarms, lights, noise, dust from unpaved streets during all hours of day and night in a residential neighborhood, and there would be lack of control of the parking lot.
c. The parking lot would create increased traffic in this residential neighborhood on the basis of ten (10) cars and some with boats, RVs going in and out 10 times per day, creating a safety hazard for the residents and the children's playground across the street on Chinook Avenue.
2. Conditional Use Review Criteria Section 6.040 - Criteria #4:
The parking lot would decrease the beauty of this residential neighborhood and decrease property values of the adjacent properties.
3. Conditional Use Review Criteria Section 6.040 - Criteria #6:
The parking lot would be problematic because there is no enforcement of parking and the area has no sidewalks and no place for increased traffic and there is no way to address the additional traffic.

The vote was 37 in favor of the motion, 7 opposed to the motion, and 9 abstaining.

There being no further business, the meeting was adjourned at 12:45 p.m.
